In this Privacy Notice, the following terms will have the following meanings:
“Data Protection Legislation” means, collectively, the UK GDPR and the Data Protection Act 2018, and includes any amendments to them;
“Personal data” is defined in the Data Protection Legislation as “any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier”. In simpler terms, it means any information about you that enables you to be identified, so it covers obvious information such as your name and contact details, but it also covers less obvious information such as identification numbers and online identifiers. In this case, it means personal data that you give to us when you become a client of ours; and

you need to know, but you can always contact us to find out more or to ask any questions using the details in clause 10. - The right to access the personal data we hold about you. Clause 9 will tell you how to do this.
- The right to have your personal data rectified if any of your personal data held by us is inaccurate or incomplete. Please
contact us using the details in clause 10 to find out more. - The right to be forgotten, i.e. the right to ask us to delete or otherwise dispose of any of your personal data that we hold.

- The right to withdraw consent. This means that if we are relying on your consent as the legal basis for using your personal data, you are free to withdraw that consent at any time.
- The right to data portability. This means that if you have provided personal data to us directly, we are using it with your
consent or for the performance of a contract, and that data is processed using automated means, you can ask us for a copy of that personal data to re-use with another service or business in many cases. - Rights relating to automated decision-making and profiling.

- It is important that your personal data is kept accurate and up to date. If any of the personal data we hold about you changes, please keep us informed for as long as we have that data.

- If you have any cause for complaint about our use of your personal data, you have the right to lodge a complaint with the Information Commissioner’s Office. We would welcome the opportunity to resolve your concerns ourselves, however, so please contact us first, using the details in clause 10.

- What Data Do We Collect?
- We may collect and process the following personal data in order for us to provide our services to you as a client of ours:
- Name;
- Date of birth;
- Contact information including your address(es), email address(es) and telephone number(s);
- Billing address(es) and contact information, if this is different from the above;
- Details of your nominated beneficiary/beneficiaries, dependent(s) and executor(s);
- Details about your estate.
- For any personal data relating to other data subjects that you may send to us or make available to us, for example data relating to your beneficiaries and executors, you will be advised when entering into the contract with us that you will need to warrant that you have obtained the permission of those individuals to pass their data to us, as a third party.
- Please also note we have included a separate privacy policy on our website, which relates only to the information we collect if you visit our website.
- How Do We Use Your Data?
- All personal data is processed and stored securely, for no longer than is necessary in light of the reason(s) for which it was first collected. Due to the nature of the services we provide, we may need to store certain data indefinitely in order to protect against legal claims, as well as to provide supporting information if your Will or other document we have created is ever questioned or contested.
- We will comply with our obligations and safeguard your rights under the applicable Data Protection Legislation at all times. For more details on security see clause 5 below.
- Our use of your personal data will always have a lawful basis, because it is necessary for our performance of a contract with you, because you have consented to our use of your personal data (e.g. by subscribing to emails), or because it is in our legitimate interests. Specifically, we may use your data for the following purposes:
- Supplying our services to you (as set out above, we require your personal data in order to enter into a contract with you);
- Replying to emails from you; and
- Supplying you with emails that you have opted into (you may unsubscribe or opt-out at any time by emailing us directly).
- With your permission and/or where permitted by law, we may also use your data for marketing purposes which may include
contacting you by email with information, news and offers on our services. We will not, however, send you any unsolicited marketing or spam and will take all reasonable steps to ensure that we fully protect your rights and comply with our obligations under the applicable Data Protection Legislation and the Privacy and Electronic Communications (EC Directive) Regulations 2003. - You have the right to withdraw your consent to us using your personal data at any time, and to request that we delete it. Unless we have reasonable grounds to refuse to delete it (where this is permitted under the applicable Data Protection Legislation), we will do so without delay and within no longer than one month from receiving your request.
- We do not keep your personal data for any longer than is necessary in light of the reason(s) for which it was first collected.
- How and Where Do We Store Your Data?
- We only keep your personal data for as long as we need to in order to use it as described above in clause 4, and/or for as long as we have your permission to keep it.
- We will only store your data in the UK, however, third party processors we use may store data elsewhere, as set out in clause 6.
- Data security is very important to us, and to protect your data we have taken suitable measures to safeguard and secure data collected.
- Do We Share Your Data?
- In certain situations, we may provide our services in conjunction with another third-party legal services provider, and we may also sometimes contract with other third parties to supply services to you on our behalf. These third parties will require access to some or all of your data. Where any of your data is required for such a purpose, we will take all reasonable steps to ensure that your data will be handled safely, securely and in accordance with your rights, our obligations and the obligations of the third party under the law.
- We may sometimes use third party data processors that are located outside of the UK. Where we transfer any personal data outside the UK, we will take all reasonable steps to ensure that your data is treated as safely and securely as it would be within the UK and under the Data Protection Legislation.
- In certain circumstances, we may be legally required to share certain data held by us, which may include your personal data, for example, where we are involved in legal proceedings, where we are complying with legal requirements, a court order or a
governmental authority.
- What Happens If Our Business Changes Hands?
- We may, from time to time, expand or reduce our business and this may involve the sale and/or the transfer of control of all or part of our business. Any personal data that you have provided will, where it is relevant to any part of our business that is being transferred, be transferred along with that part and the new owner or newly controlling party will, under the terms of this Privacy Notice, be permitted to use that data only for the same purposes for which it was originally collected by us.
- In the event that any of your data is to be transferred in such a manner, you will not be contacted in advance and informed of the changes.
- How Can You Control Your Data?
- In addition to your rights under the Data Protection Legislation, set out in clause 2, when you submit personal data to us, you may be given options to restrict our use of your data. In particular, we aim to give you strong controls on our use of your data for direct marketing purposes (including the ability to opt-out of receiving emails from us which you may do by unsubscribing using the links provided in our emails and at the point of providing your details).
- You may also wish to sign up to one or more of the preference services operating in the UK, such as the Telephone Preference Service. These may help to prevent you receiving unsolicited marketing. Please note, however, that these services will not prevent you from receiving marketing communications that you have consented to receiving.
